Too bad it wasn't really a victory as he was supposed to go to London for surgery and return to the Maldives.  Ooops, now has asylum and no treatment done (that we know of) for his severe back problems.  Me thinks someone wasn't totally truthful and it was the plan all along to get him out of the Maldives by devious ways.

How do we know he had no treatment done? Aren't medical records supposed to be private? And for him (and Amal) it's a clear victory. Going back to Maldives to prison vs refugee in the UK, it seems like he absolutely won. IMO also there was nothing dubious about this at all. He is IMO a person who definitely deserves the refugee status.

It was stated he saw doctors in Britain we have no idea what treatment or advice he receive. He is much better off in Britain than in a Jail cell for no reason at all.

Nasheed was wrongly imprisoned. He is now out, a free man due in large part to the hard work of his local lawyers and his international legal representatives, including Amal. To me that is justice.

We haven't seen Nasheed publicly in quite a while and there is no reason to believe nor is there any proof that he didn't get surgery or other medical treatment.

I'm not the sharpest knife in the draw....this is unexpected, and yet not unexpected....Britain and British Justice is famous all over the world....is it now a "back door" for Countries threatened with sanctions by hi-profile  human rights Lawyers.....

If you cannot trust a man to comply with HIS obligations (to uphold his part of a "bargain")......can you then expect or demand Countries to comply with their obligation....

Is threatening sanctions nothing but plain "BLACKMAIL".....

It just makes NO SENSE to me....

It appears to be a trend with Mrs C.....sadly....

Sanctions are a very important and many times a successful tool for the international community to use, not to blackmail, but to affect any number of wrong-doings being committed by the targeted country.

What would be sad is if Nasheed had returned to prison in the Maldives to serve out an unlawful sentence of 13 years all the while attempting to work within a corrupt government to have his case appealed ..... a country that has committed a broad range of human rights abuses.

How does one bargain with a corrupt government?
And who is the bad guy in this case?

I don't think anyone would expect him willingly to return to Maldives in order to return to prison, just to be the 'honourable' man. His trial was botched, he was illegally imprisoned. And as his lawyer, Amal's job was to get him out of prison, out of danger. How do you work with a corrupt government that illegally imprisons people, violates human rights?

I think the the government is quite happy he is not coming back. They can carry on doing as they have
been. Without him there will be no attention on them. Which is a win for them .

I don't know how they can even be compared, Nasheed was illegally imprisobed by a corrupt government, applied to a refugee status, and got it. He didn't harm or imprison anyone, but got a refugee status, which he qualified for.

How was it deceitful he left and made the decision I'm sure with his family more than any others what he wanted to do and this was an option. 

The Maldives Government may very well have known about this , I would think they would have been informed.

Like I said it is a win for them he is out of their hair and they can now do as they have been with no interference
from him.

A very harsh and unfounded accusation. Where is the indignation over the crime committed against Nasheed. And for that matter the others who have spoken out against the Maldives government and are now political prisoners in their country.

There are a few options how it was supposed to be handled on the side of the Maldives government:

a) Nasheed was allowed to go to the UK to have surgery just because his doctors said he needed to and they didn't check it via their doctors.
This would have been grossly negligiant and naive until they didn't want to get rid of him.
b) Nasheed was allowed to go to the UK after the governmental doctors checked his medical condition and agreed that he needed surgery.
This would be the most likely option IMO.

After he had left the Maldives he was supposed to return to prison after his surgery. So there could be several options as well:
c) Nasheed decided to stay in the UK because he wanted to stay with his family / realized that he would be able more efficiently to work for the opposition in the Maldives from exile than from prison.

d) There was an agreement before that Nasheed would not return to the Maldives so the government wouldn't lose face. I had said it a few times before: IMO human rights law doesn't work in the same way as other fields of law. The Maldives have already been told that Nasheed's trial was a sham trial and that he should be released. If a government does so they show weakness and admit to have made a mistake in accusing and sentencing someone. The way Nasheed's release was handled shows a lot of diplomacy for me.

If Amal was lying when she said that Nasheed needed surgery in the UK - I don't know. But a lawyer will always try to protect his client - that's his job.
And we don't know what really happened and maybe will never get to know about it...

Right, let's just bear in mind that Amal, or any leading human rights lawyer worth their salt to be honest, works very hard at a)establishing the truth, b)acting for the client whose case they have agreed to take on and c)proves her/his case to a variety of governments and government officials who will look at all the evidence and decide whether or not to support that situation usually in the interests of democracy. 

In this instance there were many visits to nearby countries, to democracies with influence and the ability to talk to those who were close to the situation both geopolitically and in terms of security.

In this instance, on this thread somewhere are all the meetings and appointments set up on that basis in India, Sri Lanka, the US, UK etc. All these institutions cannot be wrong can they?

I thought it was very interesting that the President of Azerbaijan thought fit to release Khadija the minute her case was taken to another level, and you would be forgiven for thinking that there must have been a reason for that! Long may she continue to expose possible corruption on many levels............

PAN, your last paragraph rightly points out what many of these corrupt governments fear. Exposure. An additional advantage that Amal and her team have is her notoriety. The media will cover her and her legal team's cases in a way that otherwise might go almost unnoticed. Like her husband she can help shine a light. She said as much when in Washington DC and spoke with NBC News. For her cases this is a good thing.

It may be that Azerbaijan didn't want further coverage of some of their less than above board governmental practices to be exposed. Tho it sounds like Khadija Ismayilova will continue to fight two other convictions that she was not cleared of by the government.

Nasheed did a crime when he tried to use his position and power against a judge that didn't like to take orders from him ,that's corruption and his bank account is another story and am using Melbert great quote

if he was in Maldives and a judge set him free that's another story but this way is deceitful and cheap way most lawyers do!

WWHS great point too,sanctions is blackmail ,i 'd love see Amal try to do sanctions on US or China or Japan or at least a friendly nation to the US!one method for a poor un smart deceitful lawyer!

Yep, Khadija still has convictions hanging over her because 

a) they've freed her before the case comes to court (Mm, wonder why that is?!) and


b) it would be an admission of guilt by the President of Azerbaidjan and his family if they dropped the charges

oh and if it was to save face they wouldn't let Khadija free in first place ,don't give her more than her size and she can't travel for five years IF they are afraid of Amal's bullying with American Congress men they would set her free without any criminal charges left  ,like Fahmy and Nasheed ,GUILTY!
